Lyons v. Legal Aid Society
United States Court of Appeals for the Second Circuit
68 F.3d 1512 (2d Cir. 1995)
After a near-fatal car accident left her unable to walk long distances or stand for extended periods, Lyons (plaintiff), a Legal Aid staff attorney, requested that Legal Aid (defendant) pay for a parking space near her office and the courts where she practiced, supported by her doctor's confirmation it was medically necessary for her return to work; Legal Aid refused, and the district court dismissed her ADA and Rehabilitation Act failure-to-accommodate claim for failure to state a claim, holding Legal Aid had no duty to provide such a space.
Whether a disabled employee's request for a parking space is an unreasonable request for accommodation, as a matter of law, under federal disability laws.
