Lundquist (plaintiff), suing in diversity jurisdiction, owned homes in both New Hampshire (where he paid property taxes, held a driver's license, and was registered to vote and listed as a state-resident director in corporate filings) and Florida (where he opened bank accounts, obtained a license, filed taxes, and joined social clubs); when defendant New Hampshire citizens moved to dismiss for lack of diversity, the district court found Lundquist domiciled in New Hampshire, largely based on his voter registration and corporate filings, and Lundquist appealed, arguing the court had wrongly applied a mere "residence" standard rather than "domicile."
Whether, for purposes of diversity of citizenship, a party's domicile is determined solely by where he resides.
