Ellen Geoghegan (defendant) had been a longtime patient at Sibley Memorial Hospital, operated by the Lucy Webb Hayes National Training School (the School) (plaintiff), and after the Hospital determined she no longer needed acute care and could be cared for by a nursing home, it formally demanded her husband transfer her out; her husband insisted she should remain in the Hospital until the end of her life and was willing to pay whatever charges the Hospital required for the extended stay. The School sued for an injunction ordering Geoghegan to leave, and she moved to dismiss.
Whether an injunction may be issued to enjoin a continuing trespass or a series of repeated trespasses if an action for damages would not be an adequate remedy.
