An estate subdivided into six lots, along with a private road and a separate 2.23-acre beach parcel, sold the six lots and road to Falcon, Inc. with a deed granting Falcon and its successors - including Karl Leabo (plaintiff) - the right to use the beach; Steven Leninski (defendant) later purchased the beach parcel and opened it to the public, drawing thousands of visitors to what was a small beach. Leabo sued, claiming Leninski's public opening materially interfered with his beach easement, and the lower court granted injunctive relief, which Leninski appealed.
