Lawrence v. Fox

Court of Appeals of New York

20 N.Y. 268 (1859)

Relevant factsFree

Holly, who owed Lawrence (plaintiff) $300 and had promised to repay him the next day, loaned that same $300 to Fox (defendant), who in turn promised Holly he would pay the $300 directly to Lawrence; when Fox failed to pay, Lawrence sued him directly, and Fox argued there was no proof Holly owed Lawrence money, that his agreement with Holly lacked consideration, and that no privity existed between himself and Lawrence. A jury found for Lawrence, and Fox appealed.
