Irving, Dubicki, and Camassar (defendants) were attorneys and partners in a limited liability partnership law firm. Margaret Kus (plaintiff) sued all three, claiming Irving induced her to sign a fee agreement giving him excessive fees and that he then took even more than the agreement allowed. Dubicki and Camassar moved for summary judgment, submitting affidavits stating they didn't learn of Irving's dealings with Kus until after the fees had already been paid out, and that under the partnership agreement, Irving never shared those particular fees with them.
