Kellensworth v. State
Supreme Court of Arkansas
631 S.W.2d 1 (Ark. 1982)
Relevant factsFree
John Kellensworth (defendant) was charged with rape and burglary. At trial, his mother testified he "worshipped" his ex-wife, and the prosecution then called the ex-wife, Vickie Kellensworth, solely to contradict that testimony; she testified Kellensworth had pulled a gun on her and hit her. The trial court admitted this rebuttal testimony over Kellensworth's objection, and he was convicted and appealed.
