Kalinauskas (plaintiff) sued her former employer, Caesars Palace, and its representative Wong (defendant), for sex discrimination, and sought to depose another former Caesars employee who had previously sued Caesars for the same kind of discrimination and settled under a confidentiality agreement barring her from discussing anything about her employment beyond her dates of employment and job title. Caesars asked the court for a protective order shielding that former employee from being deposed at all, arguing the confidentiality agreement should control.
Whether a party who signed a confidentiality agreement as part of a prior settlement can still be deposed about the matters covered by that settled case.
