Justice for All v. Faulkner

United States Court of Appeals for the Fifth Circuit

410 F.3d 760 (2005)

Relevant factsFree

The University of Texas at Austin (defendant) adopted a Literature Policy requiring every printed item distributed on campus to identify the school-affiliated person or group responsible for it. When school officials tried to stop Justice for All (plaintiff), a student anti-abortion group, from handing out leaflets that didn't name the group, Justice for All sued, arguing the policy unconstitutionally restricted anonymous speech in what was otherwise a designated public forum for student expression. The district court enjoined the university from enforcing the policy against Justice for All, and the university appealed.

IssueFree

Whether a university policy requiring every leaflet distributed on campus to identify its sponsoring person or organization is invalid under the First Amendment because it unduly restricts anonymous speech.
