Jole v. Bredbenner

The Bredbenners (defendants), month-to-month tenants of Jole (plaintiff), fell $4,400 behind on rent, and after meeting with Jole and her husband, agreed via a follow-up letter to pay at least $25 monthly toward the debt on top of rent. The Bredbenners made regular $25 payments for six months, then decided to move and refused to pay the remaining balance in full, arguing the agreement meant Jole couldn't demand the full balance so long as they kept making $25 payments; the trial court agreed with the Bredbenners, and Jole appealed.
