Jaskey Finance & Leasing v. Display Data Corp.

United States District Court for the Eastern District of Pennsylvania

564 F. Supp. 160 (1983)

Relevant factsFree

Jaskey Finance and Samrus Corporation (plaintiffs) bought a computer system from Display Data Corp. (defendant) under two Maryland-law contracts: an equipment contract and a separate maintenance contract. The equipment contract warranted only that Display Data would provide maintenance per the maintenance contract and would make reasonable efforts to fix program errors for one year, and both contracts stated that, except as specifically provided, there were no other warranties, express or implied. The equipment contract also had an integration clause making it the parties' final agreement. When the computer allegedly failed to work properly, Jaskey and Samrus sued for breach of express warranty, breach of implied warranty of fitness, and negligent design.

IssueFree

Whether a written contract clause stating there are no express warranties other than those specifically provided in the contract is sufficient to disclaim all other express warranties.
