The Town of Waterville acquired a plot of land in 1935. In 1947, Jarvis (plaintiff) bought 200 surrounding acres and, from 1947 to 1986, fenced in Waterville's plot along with his own, harvested Christmas trees and tapped maple trees on it, and posted "No Trespassing" signs. Waterville never entered the land during that time. In 1986, Waterville deeded the plot to Gillespie (defendant), who tried to enter the land; Jarvis sued, claiming he had acquired it by adverse possession. The trial court agreed, and Gillespie sought review.
