R.M.J. (defendant), a lawyer licensed in Missouri and Illinois, advertised his practice listing "real estate" as a practice area (not among Missouri Rule 4's 23 enumerated categories), stating he was licensed in both states, noting in capital letters his admission to practice before the U.S. Supreme Court, and mailing announcement cards to a wide audience beyond the categories Rule 4 permitted. The Missouri Bar's Advisory Committee (Committee) charged him with unprofessional conduct; the state supreme court upheld Rule 4's constitutionality, and R.M.J. appealed directly to the U.S. Supreme Court.
