Mr. and Mrs. Mosier hired attorney R. Keith Mountain (Mountain) to arrange an adoption from birth mother Angela Searles, but Mountain also told Searles he was representing her interests in the same adoption. After telling the Mosiers that fetal medical tests showed abnormalities and steering them away from the adoption, Mountain arranged for a second couple to adopt the same baby for $17,000, even though Searles's doctor had never found any abnormalities and had never discussed results with Mountain. A disciplinary panel found Mountain had represented conflicting parties, lied about the medical tests, breached his agreement with the Mosiers, acted as an unlawful baby procurer, misrepresented his role to the Mosiers' new attorney, and overcharged the second couple, and recommended disbarment.
Whether an attorney may be disbarred if, in the course of providing counsel to a client, he violates disciplinary rules or other statutes, or makes dishonest or fraudulent representations.
