In re Marriage of Noghrey

Court of Appeal of California

215 Cal. Rptr. 153 (1985)

Relevant factsFree

Kambiz Noghrey (defendant) and Farima Noghrey (plaintiff) signed an antenuptial agreement on their wedding day providing that, if they ever divorced, Kambiz would give Farima a Sunnyvale house he owned plus the greater of $500,000 or half his assets. Just seven-and-a-half months later, Farima filed for divorce and sought to enforce the agreement. Although the original document couldn't be located, the trial court heard evidence of its existence, execution, and terms, and held it existed and was enforceable. Kambiz appealed.
