In re Marriage of Graham
Supreme Court of Colorado
574 P.2d 75 (1978)
Mr. and Mrs. Graham married in 1968; Mrs. Graham worked full time as an airline stewardess while Mr. Graham worked only part time, spending most of his effort completing a bachelor's degree and an M.B.A. during the marriage. The couple accumulated no marital property. The trial court held that a spouse's education is jointly held marital property subject to equitable distribution, and awarded Mrs. Graham monthly payments to compensate her interest in her husband's education. Mr. Graham appealed, and the Colorado Court of Appeals reversed; Mrs. Graham then sought review from the Colorado Supreme Court.
Whether a wife who supports her husband while he earns an advanced degree is entitled to compensation for her efforts as a division of marital property upon divorce.
