J.F., in a long-term relationship with another woman, asked her friend W.M. to provide sperm so she could have a child. J.F. and W.M. signed a six-page agreement, drafted by J.F.'s attorney, waiving W.M.'s parental rights and J.F.'s right to child support for the resulting child, M.F. Seven years later W.M. again provided sperm, resulting in a second child, C.F.; that agreement's language addressed only "the child" expected from the first pregnancy. Years later, after J.F.'s relationship ended, the county filed a paternity suit against W.M. on J.F.'s behalf to obtain child support. The trial court held the donor agreement barred the paternity claim as to both children, and J.F. appealed.
Whether a contract waiving paternity rights and support obligations is valid where the donor provides sperm through a physician rather than through sexual intercourse.
