At a party, John Z. (defendant) and Juan G. both engaged in sexual conduct with 17-year-old Laura T., who did not object during initial touching but, once John began intercourse with her, repeatedly tried to pull away, told him she wanted to leave and needed to go home, and said that if he respected her he would honor her wishes not to continue; John nonetheless continued the intercourse for five to ten minutes after Laura's objections began. John was convicted of forcible rape and appealed, arguing insufficient evidence supported the conviction since Laura had arguably consented to the encounter initially.
Whether continuing what began as consensual sexual intercourse, after the victim clearly revokes her consent through physical and verbal objection, constitutes forcible rape.
