The State of Nebraska (plaintiff) sought to terminate Yolanda's (defendant) parental rights to all four of her children based on neglect; the record showed unsuccessful reunification and rehabilitation efforts as to her three older children, and the court terminated her rights to all four, including her youngest. Yolanda appealed only as to the youngest child, arguing it was unconstitutional to terminate her rights to that child based on findings about her treatment of the older siblings.
Is it unconstitutional for a state to terminate parental rights to one child based upon a finding that a parent has previously neglected a sibling, as long as the parent is given an opportunity to present evidence of his or her current circumstances?
