After a California court awarded Joanne (plaintiff) custody of her son Russell with visitation to his father William in California, Joanne refused to let Russell travel to California for a scheduled visit, leading a California court to hold her in contempt and transfer custody to William; while an Ohio appellate court initially found the California contempt order unenforceable for lack of proper notice, Joanne eventually relinquished custody to William, after which a California court issued an arrest warrant alleging she violated California Penal Code section 278.5(b) by preventing Russell from seeing his father, and Ohio's Governor issued an extradition warrant based on that charge. Joanne, never having left Ohio or been present in California when she refused to send Russell there, filed a petition for a writ of habeas corpus challenging her extradition as improper since she was not a fugitive from California; the trial court denied her petition, and she appealed.
Whether an individual physically located in Ohio, but who committed acts constituting a crime in another state, may be extradited to the other state even though the individual is not deemed to be a fugitive from justice.
