In re Estate of Zukerman

Rotfeld, who lived with Zukerman for 12 years, directed his bank to reissue two bonds he owned to "Louis Rotfeld, as Trustee for Audrey Zukerman" without ever executing a formal trust agreement, while separately leaving other property to Zukerman in his will; when Rotfeld and Zukerman died simultaneously in a car accident, the administrator of Zukerman's estate (plaintiff) sought to recover the bonds for her estate, opposed by the executor of Rotfeld's estate (defendant), and the trial court found Rotfeld had created a valid trust in Zukerman's favor; the executor appealed.
