United States Court of Appeals for the Seventh Circuit

430 F.3d 858 (2005)

Relevant factsFree

Judith Baker (debtor) bought a car in New Mexico, and Primus Financial Services (creditor) financed the purchase and perfected its security interest there. Baker later moved to Wisconsin but never obtained a Wisconsin title, so her New Mexico title remained effective. When Baker filed for bankruptcy, the bankruptcy trustee argued Primus should have reperfected its interest in Wisconsin. The bankruptcy court and district court both ruled for Primus.

IssueFree

Whether a creditor must reperfect its security interest in titled goods when the debtor moves to another jurisdiction, if the original jurisdiction's certificate of title remains effective.
