Hufstetler (defendant) drove a car containing several men to a gas station, where one passenger asked the station owner to fill the tank with gas and then to fetch a quart of oil; while the owner went to get the oil, Hufstetler and the others sped away without paying for the six-and-a-half gallons of gas already pumped. Hufstetler was tried without a jury and convicted of petit larceny, and he appealed.
