Amy Huelskamp (plaintiff) and Timothy Huelskamp (defendant) divorced after an unsettled, frequently acrimonious relationship marked by arguments in front of their two children; although both initially filed shared-parenting plans and the guardian ad litem recommended shared parenting (with exchanges in public places given the parents' tense relationship), Amy sought full legal custody at trial. The trial court found meaningful cooperation between Amy and Timothy would not be feasible under any shared-parenting arrangement and awarded Amy custody with visitation rights for Timothy. Timothy appealed.
Whether a court may approve a shared-parenting plan if the court does not determine that the plan is in the best interests of the children.
