Holland v. Florida

Death-row inmate Albert Holland (plaintiff) repeatedly urged his appointed attorney, Collins, to protect his one-year AEDPA deadline for filing a federal habeas petition, but Collins failed to inform Holland when the Florida Supreme Court ultimately denied relief and miscalculated when the limitations period would resume running, causing Holland to miss the deadline before learning of the ruling weeks later. The federal district court found the appeal untimely and declined equitable tolling, and the court of appeals affirmed, holding that even grossly negligent attorney conduct could not justify tolling absent bad faith, dishonesty, divided loyalty, or mental impairment.
