Holcomb v. Hoffschneider

A property listing represented by salesman Olson (defendant), acting for sellers the Hoffschneiders (defendants), stated the land totaled 6.8 acres; Olson personally walked the Holcombs (plaintiffs) around the property boundaries and guaranteed at least 6.6 acres, and they purchased it for $54,000. After discovering the property was actually only 4.6 acres, the Holcombs sued for fraudulent misrepresentation, and a jury found in their favor; the defendants argued the Holcombs couldn't have relied on Olson's representations since they had personally inspected the boundaries themselves.
Whether a buyer is entitled to rely on a seller's representations about property even after personally examining the land.
