The Holbrooks (defendants) gave the Taylors permission to use a road on the Holbrooks' property for construction traffic and general access while the Taylors built a house nearby; with continued permission from Mr. Holbrook, the Taylors later widened the road, added a culvert, and graveled it at significant expense. After a subsequent dispute, the Holbrooks strung a steel cable across the road to block the Taylors' access, and the Taylors sued to remove the cable and declare their right to use the road.
