Hoffman (defendant) laid off Castro and other known union supporters after Castro had submitted fraudulent work-authorization documents; the NLRB found the layoffs violated the NLRA and ordered reinstatement and back pay, but at a hearing to calculate back pay, Castro admitted his documents were fraudulent and he was never actually authorized to work in the U.S. Despite that admission, the NLRB later ordered back pay covering the period from termination until Hoffman first learned of Castro's unauthorized status, and after the court of appeals twice denied Hoffman's challenge, the Supreme Court granted certiorari.
