H.M. v. E.T.
New York Supreme Court, Appellate Division
76 A.D.3d 528 (2010)
H.M. (plaintiff), the biological mother of a child conceived through artificial insemination, alleged she relied on her same-sex partner E.T.'s (defendant) promise to help support the child when deciding to conceive; after the couple separated, H.M. filed a child-support petition under the Uniform Interstate Family Support Act, and the family court ordered E.T. to pay support based on equitable estoppel. The appellate division took up whether H.M. even had a viable cause of action for child support against E.T. in the first place.
Whether a biological mother of a child conceived through artificial insemination may bring a child-support claim against her same-sex partner based on the partner's promise to support the child.
