Harvey v. Dow
Maine Supreme Court
962 A.2d 322 (2008)
Jeffrey and Kathryn Dow (defendants) let their daughter Teresa Harvey (plaintiff) and son each place mobile homes on their land, with the understanding the property would eventually belong to the children. When Teresa built a $200,000 house on a specific spot she'd discussed with her parents, her father obtained the building permit and personally helped with construction. After the relationship soured, Teresa's father refused to deed her the property, and the trial court found only a vague, non-specific promise to convey the land, too indefinite to enforce.
Whether a promisor's conduct and the circumstances surrounding it can manifest an implied intent to confirm a promise to convey real property, sufficient to support promissory estoppel.
