Harris v. Yellow Transportation Co.
United States District Court for the Northern District of Texas
2008 U.S. Dist. LEXIS 112143 (2008)
Freeman Harris (plaintiff) worked for Yellow Transportation Co. (defendant) and received the company's policy guide describing its arbitration-based dispute resolution process, which stated that accepting the policy was a condition of employment for all non-union employees, including Harris. Harris refused to sign the arbitration agreement but continued working. He later sued Yellow Transportation for race discrimination, harassment, and retaliation, and the company moved to compel arbitration.
Whether an at-will employee who receives notice that arbitration is a condition of employment accepts the arbitration policy by continuing to work, even without signing an agreement.
