In 1941, Edward Strawbridge signed and acknowledged an instrument purporting to convey a 189-acre tract "to have and to hold" unto his wife, Ethel Strawbridge, her heirs or assigns forever, for one dollar in consideration. After Edward died, Ethel sued his heirs to recover title to the land. The heirs argued the 1941 instrument failed to satisfy the statute of frauds. A jury awarded Ethel title, and the heirs appealed.
