Hanson v. Hanson
Missouri Supreme Court
738 S.W.2d 429 (1987)
This appeal was consolidated with a companion case, Graham v. Graham; in both, the husbands were sole partners in oral surgery practices formed during marriage. Both wives' expert valued the Hanson practice at $442,212, including $351,077 in goodwill, while both husbands' expert, along with a third-party oral surgeon who had purchased a similar practice without paying for goodwill, testified the practice had no goodwill value and was worth only about $91,000. The Hanson trial court valued the practice at $324,862 (including some goodwill), and Dr. Hanson appealed; the Graham trial court found no goodwill and valued that practice at $90,280, and Mrs. Graham appealed that valuation.
Whether goodwill in a spouse's professional practice is marital property subject to division.
