The parties disputed whether the plaintiff reached over the fence to grab the ladder or merely let her arm hang over it, and whether the defendant then struck her arm or gently guided it back. The plaintiff sued for assault and battery; testimony conflicted, and a jury found for the defendant. The plaintiff appealed.
