Gurwell (defendant) engaged in sexually explicit online chats with someone he believed was a 14-year-old girl (actually an undercover officer), arranging to meet at a park, and his final messages rejected going to his house in favor of meeting at the park to "see where it goes"; he was arrested upon arrival and convicted of online solicitation of a minor with intent to engage in sexual contact, after the jury rejected the lesser-included offense of solicitation without that intent. Gurwell appealed the trial court's refusal to give a renunciation-defense jury instruction.
Whether the defense of renunciation applies to certain criminal offenses when the defendant completely and voluntarily renounces the offense.
