Gordon (plaintiff), an eighteen-year-old adult, was allegedly injured by malpractice from Pennsylvania doctors (defendants) while a Pennsylvania resident; she later enrolled in an Idaho college, rented and maintained her own apartment there, and secured Idaho insurance, though her school records listed her parents' Pennsylvania address, she kept a Pennsylvania driver's license and bank account, and she returned to Pennsylvania periodically for medical treatment, depositions, and visits/work. She sued in Pennsylvania federal court based on diversity jurisdiction, and the defendants moved to dismiss, arguing she remained a Pennsylvania citizen and diversity was lacking.
Whether a college student's home state will always be considered her state of residence for diversity citizenship purposes.
