Hise (defendant) registered gopets.com in 1999 for an abandoned pet-business idea, long before GoPets Ltd. (plaintiff) existed or registered its "GoPets" service mark in 2006; shortly after GoPets registered its mark, Hise transferred gopets.com's registration to his own company and separately registered several new, confusingly similar domain names (gopet.biz, gopet.org, goingpets.com). GoPets sued under the ACPA, and the district court found both the reregistration of gopets.com and the new registrations violated the Act.
Whether a registrant's transfer or reregistration of an already-registered domain name constitutes a "registration" under the Anti-Cybersquatting Consumer Protection Act.
