Twelve-year-old Todd Glaser (plaintiff) arrived at Lowther Middle School 25 minutes early and stayed outside rather than waiting inside, even though the district (defendant) had a policy requiring teachers who see students in potentially dangerous situations to try to prevent injury when reasonably able; the district provided no supervision outside the building before the school day began. Another student chased Glaser, who ran off school property into a public street and was struck by a car; Glaser sued the district for failing to provide supervision, and the trial court found no duty existed, prompting his appeal.
