Equal Employment Opportunity Commission v. Schneider National, Inc.
United States Court of Appeals for the Seventh Circuit
481 F.3d 507 (7th Cir. 2007)
Truck driver Jerome Hoefner developed neurocardiogenic syncope, a treatable but not fully controllable disorder causing sudden fainting spells, and Schneider National (defendant), the nation's largest trucking company, dismissed him under a policy adopted after another driver with the same disorder fatally drove off a bridge; the EEOC (plaintiff) sued on Hoefner's behalf alleging Schneider mistakenly regarded him as disabled and discriminated against him on that basis, and the district court granted Schneider summary judgment.
