Edwardson v. Edwardson

Arthur and Marcella Edwardson (defendant and plaintiff) signed a prenuptial agreement providing $75 monthly maintenance payments in the event of divorce. After the couple divorced, Marcella sought to enforce the agreement, but the circuit court denied enforcement based on longstanding Kentucky precedent holding such divorce-contemplating agreements void; the court of appeals affirmed, and the Kentucky Supreme Court granted review.
