Allouez Mining (defendant) operated a copper mill whose sand runoff settled on downstream tracts; about a year after the mill was built, Edwards (plaintiff) bought one such downstream tract not to use it, but specifically to pressure Allouez into buying it back at three to five times what he'd paid. When Allouez refused, Edwards sued for an injunction against further sand deposits; the trial court denied the injunction but sent the case to a jury to assess legal damages, and Edwards appealed.
