Tom Drabek (plaintiff), a minor, was throwing snowballs at passing cars with other kids when one hit Dr. Sabley's (defendant) car. Sabley got out, chased Drabek down, grabbed his arm, forced him into his own car, and then drove him downtown - well away from the scene - to find a police officer, to whom Sabley reported the incident before leaving Drabek in the officer's custody. Drabek sued for false imprisonment and battery; the trial court dismissed the complaint, and Drabek appealed.
