Drabek v. Sabley

Supreme Court of Wisconsin

142 N.W.2d 798 (Wis. 1966)

Relevant factsFree

Tom Drabek (plaintiff), a minor, was throwing snowballs at passing cars with other kids when one hit Dr. Sabley's (defendant) car. Sabley got out, chased Drabek down, grabbed his arm, forced him into his own car, and then drove him downtown - well away from the scene - to find a police officer, to whom Sabley reported the incident before leaving Drabek in the officer's custody. Drabek sued for false imprisonment and battery; the trial court dismissed the complaint, and Drabek appealed.

IssueFree

Whether self-defense, defense of a third person, and prevention of a crime are available defenses to intentional torts, and whether the reasonableness of the defendant's conduct is a jury question.
