After school officials told kindergarten teacher Dike (plaintiff) that having her baby brought to school for lunchtime breastfeeding violated a policy against bringing children to work, and separately denied her request to breastfeed off-campus during lunch under a policy barring teachers from leaving school grounds during the workday, Dike eventually took unpaid leave and sued the School Board (defendant) under § 1983 for violating her right to breastfeed; the district court dismissed her claim as frivolous.
Whether a school policy that prevents a teacher from breastfeeding her baby during the school day can be challenged as a violation of the teacher's constitutional rights.
