Daimler AG v. Bauman
United States Supreme Court
571 U.S. 117 (2014)
Argentine plaintiffs sued Daimler (defendant) in California federal court over an Argentine subsidiary's alleged human-rights abuses occurring entirely outside the U.S., basing jurisdiction on Daimler's U.S. subsidiary MBUSA, which was incorporated in Delaware, headquartered in New Jersey, but distributed cars and maintained facilities throughout California and every other state; the district court dismissed for lack of jurisdiction, and the Ninth Circuit's rulings went back and forth before the Supreme Court granted certiorari.
Whether a court can assert general jurisdiction over a corporation if the corporation's affiliations with the forum state are not so continuous and systematic as to render the corporation at home in the state.
