Community Trust Bancorp (plaintiff), a Kentucky bank using the "Community Trust" mark, sued out-of-state financial institutions (defendants) based in Texas and Louisiana that also used the "Community Trust" mark and had no physical Kentucky presence or advertising there, but maintained online banking accounts for four Kentucky-resident customers who had applied online and received passwords to access those accounts. The defendants moved to dismiss for lack of personal jurisdiction.
Whether the provision of online banking services within a state can serve as the basis for personal jurisdiction if interaction with a resident of that state was specifically intended.
