Commonwealth v. Virgilio

Lisa Virgilio (defendant), while intoxicated, crashed into a parked vehicle on a private driveway connecting three residences to a public road; the driveway served no business purpose, had no features suggesting public access, and was open only to residents and their social visitors. She was convicted under a statute prohibiting impaired driving on any way or place to which the public has a right of access or to which the public has access as invitees or licensees, and she appealed.
