Commonwealth Building Corp. v. Hirschfield

Hirschfield (defendant) arranged movers who worked continuously from September 27 through the lease's September 30 expiration date but couldn't finish moving his belongings until the early morning of October 1; his lease provided for double rent if he held over. Commonwealth Building Corp. (plaintiff) declared him a holdover tenant liable for a full additional year of double rent and sued for $3,300; the jury awarded only $1,100, and Hirschfield appealed.
