Comcast (plaintiff) contracted with a condominium developer to install cable infrastructure and provide bulk-rate broadband services to residents, with a provision acknowledging the contract was subject to termination under a Florida statute allowing cancellation of condominium operation, maintenance, or management contracts by a 75 percent owner vote. The condominium association (defendant) later voted to cancel and hired a new provider; when Comcast refused to release its lock boxes, it sued for breach of contract and trespass, and the trial court ruled for the association.
