Walgreen (defendant) had separate Retailer's agreements with Collins Drugs and other Wisconsin pharmacies (plaintiffs), each terminable on 30 days' notice; after determining it was receiving an inadequate return, Walgreen gave notice and terminated all its Wisconsin Retailer's agreements statewide, effective October 1, 1980. The plaintiffs sued under the Wisconsin Fair Dealership Law (WFDL) for damages and injunctive relief, and Walgreen moved for summary judgment, arguing the WFDL was not intended to reach statewide, nondiscriminatory terminations driven by legitimate business considerations.
Whether the Wisconsin Fair Dealership Law permits a business to cancel all of its dealership agreements within the state without good cause.
