Cochran v. Robinhood Lane Baptist Church
Court of Appeals of Tennessee
2005 WL 3527627 (2005)
After Reverend Cochran's death, Robinhood Lane Baptist Church (defendant) agreed to pay his widow Annie (plaintiff) roughly $784 twice monthly for five years plus lawn service, terminable on her death or remarriage, replacing the benefits she'd previously received through her husband's employment; during the five years, Annie declined a marriage proposal, but the Church stopped making payments before the term ended. Annie sued for breach of contract and, later, promissory estoppel, arguing she had detrimentally relied on the Church's promise and had fulfilled her role as "first lady" of the Church; the trial court granted the Church summary judgment.
Whether a substantial detrimental action or forbearance by a promisee in reliance on a gratuitous promise constitutes sufficient consideration for an agreement.
